Fitness for Duty
DEFINITION
These examinations are requested by companies when a worker is felt to be at risk. The issue may be safety, efficiency, work performance or proper placement of an employee. Some examples are falling asleep on the job, frequent accidents, change in behavior and/or change in appearance suggestive of a serious health problem. Many times the employee is either unaware of a problem or is trying to hide something. This results in reluctance on the part of the employee/patient to be cooperative. These examinations are legal under the ADA as long as the focus remains on the work-related issues. Therefore, these examinations are extremely delicate and require direct communication between the company and the physician being asked to do the evaluation. There is no standard format for these examinations. They are tailored to the specific situation, the issues which management has concerns about, and the job requirements as documented in a written job description or job analysis. The physician performing these evaluations must have at least one or preferably two hours of uninterrupted time to spend with patient/employee.
